March 2010 - Police Records Checks - The long and hard fought battle around the requirement of police records checks (PRC) on job descriptions is over.
In summary:
New hires (non-CUPE members) will provide a PRC when required.
CUPE members being transferred or promoted into a position that requires a Type II PRC will provide a PRC if they do not have one on file that is less than 6 months old.
CUPE members who currently don’t require a PRC or are in a Type I position, and who are rehired, transferred, or promoted to related positions within the same department will not be required to provide a PRC.
CUPE members transferring or being promoted into another department, changing from Schedule ‘A’ to ‘B’ or vice versa, or otherwise moving into a fundamentally different position will require a PRC if they do not have one on file that is less than 6 months old. If they do have one that is older than 6 months they will be allowed to sign an affidavit or affirmation indicating that they have not had subsequent criminal charges. “Fundamentally different positions” has been defined as moving to a position that encompasses providing direction and supervision to other staff (i.e. Leadhand).
Type II PRC are required for positions in which the employee is in a position of trust who work directly with children up to the age of 18, or vulnerable persons.
